The non-profit organization Power to Transform filed a Writ of Mandamus today with the District Court at the Coleman County Courthouse.  Basically this document is a petition requesting Judge Weeks to compel the City of Coleman to comply with their charter and allow the 2 electrical petitions to come to a vote of the citizens.  More information coming soon.

Today at 4:00 pm, Power to Transform, Inc. filled a petition for a writ of Mandamus with the District court in Coleman, Texas.

 

Although this is a rather complex legal document, it boils down to this simple statement.

 

We the people are asking the judge to take a look at this matter, the fact that the city of Coleman has denied its citizens their democratic right to vote, and compel the city to follow the law (its own charter) and bring this matter to a popular vote.

 

This is what democracy is all about. People voting on issues that affect their life so deeply is what America was founded on!

 

We believe the arguments are very strong and compelling and therefore have a great deal of optimism that justice will prevail; allowing the voices of the people of Coleman to be heard.

 

The setting (court date) is set for September 10th, 2015 at 2:00 p.m. (everyone is welcome and encouraged to come.)  (Upstairs in the Coleman Courthouse)

 

There is the possibility the city will try to delay this date to try to prevent it from coming to the Nov. ballot, but I do not believe Judge weeks will tolerate any nonsense.

 

Power to Transform is a non-profit corporation, setup to be an advocate for the citizens and businesses of Coleman. More information on PTT will be coming soon.  If you are interested in becoming a member (no mandatory dues) to help us help others, then let us know. This folks is just the beginning, Coleman deserves a break and times are tough enough without having to endure the highest electrical bills in Texas.

 

In filing these documents without legal representation we are capable of taking the battle to the highest level without the concern that we (PTT members), will not be able to afford the final phase. Although this move may seem risky at best, we trust in a higher power and if this movement is meant to be, it will be! Truth and justice are powerful forces.

 

 

May the Lord give each and everyone peace, no matter which side of this issue you are on. May you rest well!

The number hours you've spent working on this project can only have been exceeded by the number of hours you've spent in prayer about it.

Thank you Nancy. Wish I could have gotten this done sooner.


Looks like the clerk erred in setting the Sept. 10th court date, since by law the city has 21 days to respond to the writ. After they respond (and they will), the judge will review and most likely set a court date at that time.

So looks likes we missed the Nov. election, but this is OK.  It would have been much more difficult to get a good turn out in November, compared to May where the city will be in high gear with city elections.

So NO Court setting this next Thursday (Sept. 10th) -- We'll keep you informed.

So, I'm pleased to announce at this time, the firm that will be representing PTT and the citizens of Coleman who just want relief from these abusive electrical rates, is the law firm of Zollie Steakley, PLLC http://www.zolliesteakley.com/

After speaking only a few minutes with Mr. Steakley the first time, I realized he has the perfect set of qualifications required to bring relief to Coleman.

Mr. Zollie has been practicing law since the 70's, which brings both loads of experience and a hourly rate that is in concert with this experience, but  ... quality does not come cheap and I simply cannot give up and let the city management wreck havoc on its people simply because it cost real dollars to defend them.

In addition, Mr. Zollie  has graciously agreed to handle the case up to the point of bringing the matter to the ballot for a set maximum price, which I'm happy to announce has now been fully paid in advance.  So the city cannot "out money" us, simply by trying to drag this through the mud. They're going to have to come up with legitimate arguments that can convince the court that the people somehow don't have a right to petition its own city council to bring this to ballot where it can be voted on. So far, they are lacking.

Back to the money ... yes we could use some donations to help defray this cost if you feel you are in the position to donate, even 10 dollars is a big help,  If the case needs to go to appeal (probably not likely) we will need additional funds to move forward, but that is a discussion for a later date.  Remember, if this goes to ballot (which I truly believe will happen), then we all will see some very substantial savings when it comes to how much we have to dish out for electricity.  We'll get our money back.

Due to the fact that this is an ongoing case, I cannot comment precisely on how how we are proceeding, but I promise to keep everyone informed a bit more real time, whenever it is possible.

The most important point today is ..  that we HAVE A CASE and we a have retained the talent to prove it!  

The members of PTT are actively working for Coleman! Would you like to be a part of this movement ... let us know, we would love to hear from you.

What is happening is monumental.........and.........eventually..............will be appreciated by the city council, itself, along with the citizenry in general.........as a long-term log-jam is being broken................our city government is woefully outdated and grossly inefficient and ineffective (compared to the level it could, and, should be operating at............"stuck in the mud" hardly begins to describe it)............there are quite a many areas that are near as harmful as the electricity distribution for "profit" scam that are waiting in the wings for change.............all hale the coming of the current writ and its decision, whatever it may be, as this is just the first salvo in getting our councils' (plural) attention and cooperation, as this process is going to take several years and cycles to break thru.........................with improvements coming in stages, with citizen inputs all along the way.................
