The fifth proposition on the May ballot will be: 

Proposition E

An amendment to the City Charter providing that should a Councilmember or the Mayor fail to continuously reside within the City Limits during their term of office that they shall forfeit their office. 

The wording of this proposal as it was presented at prior public hearings was:

Measure D

An amendment to the City Charter providing that should an individual elected under the Charter fail to continuously reside within the City Limits during their term of office that they shall forfeit their office.

Originally scheduled to be the fourth measure to appear on the ballot, this proposition has been moved to fifth place.

A change in wording of the final proposition from that originally proposed replaces the words, “… an individual elected under the Charter …” with the words “… a Councilmember or the Mayor …”. 

In other words, only the councilmembers and mayor are required, under this proposition, to maintain city residency. 

The earlier review of this proposition when it was named “Measure D” was: 

Proposition Number 4 (#4)

 

An amendment to the City Charter providing that should an individual elected under the Charter fail to continuously reside within the City Limits during their term of office that they shall forfeit their office.

 

If citizens vote “yes” on this proposition, a fifth (5th) ** paragraph will be added to Section 2.04.  The amended section will say:

 

Section 2.04     Qualifications.

 

Each of the four (4) Council members, the Mayor, and Chief of Police shall be citizens of the United States of America and a registered qualified voter of the State of Texas, and shall be at least 18 years of age; and shall live within the corporate limits of the City of Coleman, and shall have resided within the corporate limits for at least one (1) year preceding the election at which they are candidates. Each of the four (4) City Council persons shall have lived within the Ward for which they are filing for a minimum of one (1) year immediately preceding the election at which they are a candidate. They shall not be in arrears in the payment of any taxes or other liability due the City nor be disqualified by reason of any provision of any other section of this Charter.

 

Candidates for Chief of Police shall, at the time of filing, possess a minimum of a Basic Certificate issued by the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE).

 

A member of the Council, or Chief of Police, ceasing to possess any of the qualifications specified in this section, or any other section of this Charter, or convicted of a felony while in office, shall immediately forfeit the office.

 

In accordance with state law, no member of the Council shall hold any other public office within the City, except that of Notary Public or member of the National Guard, Naval or Military Reserve, or be a retired member of the Armed Forces.

 

**   Any individual elected under this Charter shall continually reside within the City limits of the City of Coleman during their term of office.  The failure to reside within the City lim its of Coleman shall result in an automatic vacancy in the office, said vacancy to be filled consistent with the process for filling a vacancy as provided for in this Charter.  A Council member who moves from the Ward from which they were elected but continues to reside within the City limits of the City of Coleman does not, as a result of such move, vacate their office. 

 

At the present time, the section reads:

Please Note:  This is the second time a change has been recommended to section 2.04.  The first time was when Proposition Number One (#1) recommended eliminating the sentence that begins, “They shall not be in arrears”.  That change is not reflected here.
