The tenth proposition that will be presented for voter approval will be:

Proposition J

An amendment to the City Charter providing that the Fire Chief shall be appointed by the City Manager with confirmation by the City Council. 

The wording of this amendment when presented at previous public hearings was:

Measure H

An amendment to the City Charter establishing the authority of the City Manager to appoint the City Secretary and to Appoint, with the confirmation of the City Council a Fire Chief.

The wording of this proposition has been changed.  The phrase “… establishing the authority of the City Manager to appoint the City Secretary and to appoint, with the confirmation of the City Council a Fire Chief” has been eliminated. 

The proposition now deals only with appointment of the fire chief.  Appointment of the city secretary now is dealt with in Proposition I (old #9).   

Approval to change Section 2.09, City Secretary, is no longer requested under this proposition.   

The earlier review of this proposition said:  

Proposition Number Eight (#8)

 An amendment to the City Charter establishing the authority of the City Manager to appoint the City Secretary and to Appoint, with the confirmation of the City Council a Fire Chief.

If approved, this proposition would change two sections of the existing charter.  The first of those sections will then say:

Section 2.09    City Secretary

The City Manager shall appoint, and may remove without cause, a City Secretary, and such Assistant City Secretaries as deemed advisable, whose duties and obligations shall be determined and supervised by the City Manager.

At the present time, that section now says:

Section 2.09     City Secretary.

The City Council shall appoint and/or remove the City Secretary and such Assistant City Secretaries as the City Council shall deem advisable. Such appointees shall be residents of the City of Coleman. The duties of the City Secretary or and Assistant City Secretary shall be as required by law, and as established by the Job Description adopted by the City.

 

The second section that would be changed by a “yes” vote to this proposition is 5.09, which ….. after being changed …. will read:

Section 5.09     Fire Department.

The City shall take all necessary measures to protect the City and the property of its citizens from destruction by fire or conflagration; and shall have the authority to establish and maintain a fire department within the City, at such time as State Statutes may require, or as the Council may deem advisable, and to cooperate with any person, other governmental body, association, or corporation in the operation of the fire department, under such terms as the City Council may prescribe by ordinance. Authority is also granted to support and assist in the maintenance of a volunteer fire department.

The City Manager shall appoint, with the confirmation of the City Council, a Chief of the Fire Department, whose duties and obligations shall be determined and supervised by the City Manager.  The City Manager may remove a Fire Chief, with or without cause, without requiring the confirmation of the City Council. 

At the present time, the section says:

Section 5.09     Fire Department.
